A man named Vimal Kariya in Porbandar had filed a petition to declare his as marriage illegal and divorce the woman he married.
Petitioner Vimal Kariya’s lawyer Bharat Lakhani filed the case under Section 12 of the Hindu Marriage Act.
According to the man, his wife tied the knot with her first husband, who has a criminal record in Assam, without divorcing him. However, they could not produce the necessary documents related to Karia’s wife’s divorce petition in an Assam court.
Kariya’s wife had arrived in Assam a few months ago and a few days later he received a call from a lawyer saying that his wife had been arrested and needed money to release her. Kariya sent 1 lakh rupees as installment and asked to send the court documents. After going through the documents Karia concluded that the woman was already married and she married Karia to avoid arrest without divorcing her first husband as both she and her first husband were involved in many criminal cases in Assam.
